2006 National Qualification Examination for Patent Agents

I.          
“Notification
of 2006 National Qualification Examination for Patent Agents”

On 27 January 2006, the State Intellectual
Property Office of the People’s Republic of China (SIPO) published the “Notification of 2006 National Qualification
Examination for Patent Agents”.  The relevant examination arrangements and
SIPO’s reform measures on the examination system are summarised as follows:

(1)    Examination
Arrangements

Date of Application

Eligible residents of the Hong Kong Special
Administrative Region can file their applications to the Intellectual Property
Department from 10 May to 30 June 2006.

Examination Schedule

The National Qualification Examination for Patent
Agents will be held nation-wide from 4 to 5 November 2006.

Examination Venue for Hong Kong candidates

Guangzhou examination
centre.

Arrangement for payment of Examination Fee by Hong Kong candidates

Eligible Hong Kong candidates are required to pay an application fee of RMB30 when
they report to the Guangzhou
examination centre on 3 November 2006.

Examination Syllabus

Candidates can purchase from various examination centres
in March 2006 the Guide to 2006 National Qualification Examination for Patent
Agents which includes the examination syllabus and the relevant laws and
regulations.

(2)    Reform Measures
on the Examination System

According to the Notification of 2006 National
Qualification Examination for Patent Agents, reform on the examination system
has been undertaken by the SIPO.  Measures include:

Examination Schedule

The schedule is revised so that the National
Qualification Examination for Patent Agents will be held annually on the first
weekend of November.

Subjects and Contents

Examination subjects have been revised to include
knowledge on patent laws, relevant legal knowledge and work practices of patent
agents.  The examination syllabus has been re-compiled in accordance with
the revised subjects and contents.

Release of Question Papers and Answers after the
Examination

After the examination, SIPO will release the
examination papers of the following two subjects with draft model answers: (i)
knowledge on patent laws; and (ii) relevant legal knowledge.  Comments
from the public are welcomed within a specified period so as to finalise the
marking scheme.

After issuing certificates to the successful
candidates, SIPO will release the examination paper of the subject of work
practices of patent agents with the relevant model answers.

Admission Criteria

The proportion of candidates admitted will be
determined according to the actual demand for patent agents.  Candidates
will be admitted based on their total examination scores and their scores for
the single subject of work practices of patent agents.  Candidates with
the best scores will be admitted.  The admission rate will be determined
by the Patent Agents Examination Board (專利代理人考核委員會) after
deliberation.

背 景
在 保 險 中 介 人 素 質 保 證 計 劃 (以 下 簡 稱 「該 計 劃」)
實 施 之 前 ， 保 險 中 介 人 (即 保 險 代 理 人 及 保 險 經 紀) 均 不 一 定 需 要 通
過 任 何 公 開 考 試 的 考 核 。 有 鑑 於 日 趨 複 雜 的 保 險 產 品 及 規 管 條 件 ，
保 險 中 介 人 的 專 業 水 平 必 須 提 高 ， 藉 以 保 障 投 保 人 士 的 利 益 。 因 此
， 保 險 業 監 理 處 倡 議 推 行 該 計 劃 ， 並 獲 得 業 界 及 有 關 機 構 的 普 遍 支
持 。

計 劃 內 容
保 險 中 介 人 素 質 保 證 計 劃 的 實 施 日 期 為 二 零 零 零
年 一 月 一 日 。 按 照 該 計 劃 ， 所 有 保 險 中 介 人 、 其 行 政 總 裁／負 責 人 及
業 務 代 表 必 須 通 過 由
職 業 訓 練 局 轄 下 的 高 峰 進 修 學 院 考 試 中 心 舉 辦 的 保 險 中 介 人 資
格 考 試 (獲 豁 免 者 除 外) ， 並 於 日 後 符 合 持 續 專 業 培 訓 計 劃 的 規 定 。

該 計 劃 的 督 導 委 員 會 由 保 險 業 界 及 有 關 專 業 團 體
的 代 表 、 代 表 保 險 界 功 能 組 別 的 立 法 會 議 員 及 獨 立 人 士 所 組 成 。 督
導 委 員 會 負 責 就 該 計 劃 制 訂 政 策 方 向 。

■ 保險中介人資格考試

　　保險業監理處由二零零零年一月一日起推出的一項全新素質保證計劃，將有助提高本港保險中介人及保險業的專業地位和水平。

　　在保險中介人素質保證計劃下，約五萬名保險代理人和經紀、他們的行政總裁及業務代表，除一些已持有認可保險或精算師資格的從業員外，均須在登記或取得授權前，參加公開考試。

　　他們日後更必須參與持續專業培訓計劃，以維持其登記或授權資格。

　　現時保險代理人和經紀在登記或獲授權前，並非全部均須參加公開的專業資格考試。

　　保險業監理專員黃志光今日（星期一）在記者會上解釋：「過去數年，保險中介人的數目急劇增加，而保險產品則愈來愈複雜和多元化。」

　　「我們實在有需要確保保險中介人擁有足夠的保險知識，及優質的服務水平，令投保人士放心。這項計劃亦符合國際的做法，因為世界很多地方的保險中介人在取得註冊資格前，均須通過公開考試。」

　　保險中介人資格考試有四張試卷，分別為保險原理及實務（第一部分）、一般保險（第二部分－甲）、長期保險（第二部分－乙）以及強制性公積金計劃（第三部分）。

　　這三部分的考試範圍，涵蓋保險的主要原理和特點、保險中介人操守守則、強積金概念和特點、強積金計劃的註冊、強積金投資基金批核及有關的監管架構。

　　黃志光指出，所有保險中介人在經營相關的保險中介業務前，必須通過資格考試的有關試卷。

　　他補充說：「不過，除強制性公積金計劃考試外，保險從業員將有豁免及過渡安排。我們會安排兩年的過渡期，以便他們達到資格考試的要求。」

　　職業訓練局是素質保證計劃的認可主考機構，負責安排和舉辦保險中介人資格考試。

　　考試將公開讓公眾人士參與。強制性公積金計劃考試已於今年八月展開，而其餘的三科保險考試將於十月二十五日開始舉行。

　　黃志光說：「最初階段，保險考試將每週進行。但視乎情況而定，考試時間表可以調整，以應付需求。」

　　為協助考生預備有關考試，每張試卷均有一套研習資料手冊。該套手冊可從保險業監理處網頁（ｈｔｔｐ：／／ｗｗｗ．ｏｃｉ．ｇｏｖ．ｈｋ）及職業訓練局網頁（ｈｔｔｐ：／／ｗｗｗ．ｖｔｃ．ｅｄｕ．ｈｋ／ｃｐｄｃ）下載。有興趣的人士也可到職業訓練局辦事處，繳交三十元的象徵式收費索取資料手冊的複本。

　　職業訓練局亦會舉辦考試預備課程。考試手冊及報名表格可到該局辦事處索取，也可從職業訓練局網頁下載。
